Terms of Service

1. Acceptance

These Terms of Service (“Terms”) are a contract between you and Zincan LLC, doing business as Birthday Bash, a limited liability company registered in North Carolina, United States (“Birthday Bash”, “Zincan”, “we”, “our”, “us”). By creating an account, using the website or mobile app, or tapping a Birthday Bash link sent to you, you agree to these Terms. If you do not agree, do not use the service.

2. What Birthday Bash is

Birthday Bash helps you remember the birthdays of people you care about and organize the party. You can plan a bash for yourself or for someone else. Guests and honorees can RSVP or pick a date from a private link — no account required. We are not a venue, caterer, or payment processor for the party itself.

3. Accounts

Organizers create an account with an email address (and, optionally, a mobile number). You are responsible for your credentials. You must be at least 13 years old. If you use Birthday Bash on behalf of someone else, you represent you have permission to invite them and to give us their name and a way to reach them for that invitation.

4. Messaging and SMS

By entering your mobile number and checking the consent box on birthdayba.sh or in the app, or by sending START to (424) 677-0808 after seeing the SMS disclosure, you agree to receive party planning texts from Zincan / Birthday Bash: invitations, RSVP reminders, honoree plan links, and headcount recaps. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help.

5. Other people’s contact details

When you add a guest or honoree, you give us a name and a phone number or email solely so we can send that invitation. Contact details are write-only after that: we do not show them back to you, to other guests, or to the honoree. See our Privacy Policy.

6. What you pay for

Keeping your birthday book, adding people, and planning a bash are free. There is one charge, and it is for sending a bash — the moment invitations actually go out to your guests. It is a one-time charge per bash, not a subscription: there is nothing recurring and nothing to cancel.

The price depends on how many guests the bash covers, and the current prices are shown on birthdayba.sh and again in the app before you pay. What you are buying is a guest allowance, not a single send — you can add people you forgot and invite them at no extra cost. If a bash grows past its allowance you pay only the difference between the two sizes, never the larger price a second time.

Payments are processed by Stripe. We never see or store your card details. Prices are in US dollars and may change; a change never affects a bash you have already paid for. Bashes created before we introduced charging remain free permanently.

Refunds. If a charge went wrong — you were billed twice, or the invitations never went out — email hello@birthdayba.sh and we will refund you. Once invitations have been delivered to your guests we cannot un-send them, so that part is not refundable, but talk to us if something has gone wrong and we will sort it out.

To be clear about what this charge is not: it is for sending your invitations. We are not a venue, caterer, ticketing service, or payment processor for the party itself, and no money for the party passes through us.

7. Acceptable use

Do not use Birthday Bash to spam, harass, or send invitations to people who have not indicated they want them. Do not attempt to extract other users’ data. We may suspend accounts that break these rules.

8. Disclaimers

The service is provided as-is. We work hard not to miss a birthday; we do not warrant uninterrupted or error-free operation. To the extent permitted by law, Zincan LLC is not liable for indirect, incidental, or consequential damages arising from your use of Birthday Bash.
